Terms & Conditions

These are Idatanet's terms and conditions. Our Terms of Sale apply to every purchase, whether made online or by quote, email or purchase order. Our website policies explain returns, shipping, privacy and the use of this site in plain English.

Terms of Sale

Version 2.0 · Effective 19 October 2026

These Terms apply to every purchase from Idatanet, whether made through our online store or by quote, email or purchase order.

  • Part A (clauses 1 to 15) applies to all customers.

  • Part B (clauses 16 to 24) applies to Business Customers.

  • Part C (clauses 25 to 29) applies to Consumers and explains your rights under the Australian Consumer Law.

  • Part D (clauses 30 to 36) applies to Subscription Services.

Nothing in these Terms limits your rights under the Australian Consumer Law or any other law that cannot be excluded.

Part A – General Terms (all customers)

1. Definitions and interpretation

1.1 In these Terms:

  1. ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

  2. Agreement has the meaning given in clause 2.5.

  3. Business Customer means a customer who acquires Products in the course of, or for the purposes of, a business, including any customer with a Trade Account.

  4. Business Day means any day except a Saturday, Sunday or public holiday in Victoria.

  5. Consequential Loss means loss beyond the normal measure of damages and includes indirect loss, loss of reputation, loss of profits, loss of actual or anticipated savings, loss of data, loss of bargain and loss of opportunity.

  6. Consumer has the meaning given to it in section 3 of the ACL. A Business Customer may also be a Consumer (for example, where the price of the Products is $100,000 or less).

  7. Consumer Guarantees means the guarantees that apply under Part 3-2, Division 1 of the ACL.

  8. Default Rate means the rate fixed from time to time under section 2 of the Penalty Interest Rates Act 1983 (Vic).

  9. Delivery Costs means the delivery charges shown at checkout or in a Quote.

  10. Force Majeure Event means any event beyond the reasonable control of a party, including fire, flood, storm or other natural disaster, epidemic or pandemic, war, terrorism or civil unrest, industrial action (other than by that party's own personnel), cyber attack, failure of public utilities or telecommunications networks, component shortages or manufacturer supply allocation, unavailability of transport, acts or orders of government, changes in law, tariffs or trade restrictions.

  11. Goods means goods we supply, including routers, gateways, modems, antennas, cables, wireless equipment, accessories and spare parts.

  12. GST has the meaning given in A New Tax System (Goods and Services Tax) Act 1999 (Cth).

  13. Idatanet, we, us and our mean Idatanet Pty Ltd ACN 117 723 609 of 1 Contour Close, Research VIC 3095.

  14. Insolvency Event means, in relation to a body corporate, a liquidation or winding up or the appointment of a voluntary administrator, receiver, manager or similar officer to it or any substantial part of its assets; in relation to an individual or partnership, an act of bankruptcy or entering into an arrangement with creditors; in relation to any person, the inability to pay its debts as and when they fall due; or anything with substantially the same effect.

  15. Intellectual Property Rights means all intellectual and industrial property rights anywhere in the world, including rights in patents, copyright, designs, trade marks, software, confidential information and know-how, whether registered or not.

  16. Loss means any loss, liability, cost, expense, damage, charge, penalty or payment however arising, and includes direct loss and Consequential Loss.

  17. Online Store means our website and online store at idatanet.com.au.

  18. Order means an order for Products placed through the Online Store, by email, by purchase order or by any other method we accept.

  19. PPSA means the Personal Property Securities Act 2009 (Cth), and PPSR means the register established under it.

  20. Price means the price of the Products shown in the Online Store or in a Quote at the time we accept your Order.

  21. Products means Goods, Software and Subscription Services.

  22. Quote means a written quotation we give you.

  23. Software means any software, firmware, application or cloud platform supplied with or for the Goods, whether by us or by the manufacturer.

  24. Subscription Services means any service we supply on a recurring basis, including SIM and data plans, cloud device management, software subscriptions, support plans and extended warranties.

  25. Terms means these Terms of Sale, as updated under clause 15.2.

  26. Trade Account means a credit account approved by us following a Trade Account Application.

  27. Trade Account Application means our trade account and credit application form, as completed by you and approved by us.

  28. you and your mean the person who places an Order with us.

1.2 In these Terms, the singular includes the plural and vice versa; "including" is not a word of limitation; headings are for convenience only; a reference to legislation includes that legislation as amended or replaced; no provision is to be interpreted against a party because that party prepared it; and all amounts are in Australian dollars unless stated otherwise.

1.3 If there is any inconsistency, the following apply in this order of priority: (a) any separate written agreement signed by you and us; (b) Part C, for Consumers; (c) our written acceptance of your Order and any Quote; (d) Part D, for Subscription Services; (e) Part B, for Business Customers; (f) Part A; and (g) your Order, but only for quantities, delivery details and requested dates.

2. Ordering and how a contract is formed

2.1 Product listings and prices in the Online Store, catalogues and price lists are an invitation to order, not an offer to sell. When you place an Order, you make an offer to buy the Products on these Terms.

2.2 Before you submit an Order through the Online Store, we will show you a summary of your Order, including the Products, quantities, the total price (including GST) and Delivery Costs, so that you can check it and correct any errors.

2.3 To place an Order through the Online Store, you must tick the box confirming that you accept these Terms. We keep a record of the version of these Terms that applied to your Order.

2.4 After you place an Order through the Online Store, we will send you an email acknowledging that we have received it. That acknowledgement is not acceptance of your Order.

2.5 A binding contract (Agreement) is formed when we accept your Order by email or dispatch the Goods (or activate the Subscription Services), whichever happens first.

2.6 Unless it states otherwise, a Quote is valid for 30 days.

2.7 We may decline an Order before we accept it, including where the Products are unavailable, we cannot deliver to your location, we suspect fraud or unauthorised use of a payment method, or the Order does not meet our credit requirements. If we decline an Order, we will promptly refund any amount you have paid.

2.8 If an obvious error has been made in the price, description or image of a Product, we may cancel the affected Order (or part of it) before dispatch, even after acceptance. We will tell you promptly and refund in full any amount you have paid for the cancelled Products, or, if you prefer, supply the Products at the correct price.

2.9 You must be at least 18 years old to place an Order or open an account in the Online Store.

2.10 Any terms included in or referred to in your Order (including your standard terms of purchase) do not form part of the Agreement.

3. Prices and payment

3.1 Prices shown to Consumers in the Online Store are in Australian dollars and include GST. Prices shown to Business Customers who are logged in to a trade account may exclude GST, and will be clearly marked "ex GST". The total price, including GST and Delivery Costs, will be shown before you pay.

3.2 We may change Prices in the Online Store at any time, but a change will not affect an Order we have already accepted.

3.3 You can pay using the payment methods shown at checkout or in a Quote. Card payments are processed by a secure third-party payment provider, and we do not store your full card details.

3.4 We do not charge a surcharge for payments made by eftpos, Visa or Mastercard debit, credit or prepaid cards. Any surcharge for another payment method will be shown before you pay and will not exceed our reasonable cost of accepting that payment method.

3.5 Unless you have a Trade Account, you must pay for your Order in full when you place it or, for Orders placed by Quote, before we dispatch the Goods. Orders paid by bank transfer will be processed once cleared funds are received.

3.6 We may carry out fraud and identity checks on any Order and may cancel an Order, and refund any amount paid, if we reasonably suspect fraud.

4. Delivery

4.1 We deliver to addresses in Australia and New Zealand. Orders for delivery to other countries may be accepted at our discretion under clause 13.

4.2 Delivery Costs are shown at checkout or in the Quote. If we choose to send your Order in more than one shipment, we will not charge additional Delivery Costs.

4.3 Dispatch and delivery times are estimates. We will tell you promptly if we expect a significant delay. If the Goods have not been delivered within 30 days after the estimated delivery date, for a reason other than your act or omission or a Force Majeure Event, you may cancel your Order for the undelivered Goods and we will refund the amount you paid for them, including the related Delivery Costs.

4.4 You must give us a correct and complete delivery address. If Goods cannot be delivered because the address is incorrect or no one is available to accept them, we may charge you the reasonable cost of redelivery.

4.5 If you choose an "authority to leave" option, the Goods are delivered when the carrier leaves them at your delivery address.

4.6 If Goods are lost or damaged in transit before delivery, we will replace them or refund you in full.

4.7 Please inspect the Goods when they arrive and tell us as soon as possible (and, for Business Customers, within 5 Business Days) if anything is missing, incorrect or damaged in transit. This does not limit your rights under the ACL.

4.8 If collection is offered at checkout, you may collect your Order from our premises during business hours once we notify you it is ready.

5. Risk and title

5.1 Risk in the Goods passes to you on delivery or collection.

5.2 Title in the Goods passes to you when we receive payment in full. For Business Customers with a Trade Account, clause 19.1 applies instead.

6. Cancelling an Order

6.1 You may cancel an Order by contacting us before the Goods are dispatched (or, for Subscription Services, before they are activated). We will refund in full any amount you have paid for the cancelled Products.

6.2 Clause 6.1 does not apply to Goods that have been specially ordered, configured or programmed for you. For those Goods, we may charge our reasonable costs incurred as a result of the cancellation, including any supplier cancellation or restocking charges, which we will itemise on request.

6.3 We may cancel an accepted Order, in whole or in part, before dispatch if we reasonably believe we cannot supply the Products as agreed (for example, because a product has been discontinued or is on manufacturer allocation). We will tell you promptly and refund any amount you have paid for the cancelled Products.

7. Change-of-mind returns

7.1 If you change your mind about Goods bought from us, you may return them within 14 days after delivery if:

  1. you contact us first and obtain a return authorisation number;

  2. the Goods are unused and in their original unopened, sealed packaging, with all accessories, manuals and labels; and

  3. the Goods are in a condition that allows them to be resold as new.

7.2 For an accepted change-of-mind return, we will refund the Price of the returned Goods less a restocking fee of 15% of that Price, within 10 Business Days after we receive and inspect the Goods. Original Delivery Costs are not refunded. You are responsible for the cost of returning the Goods, and they remain at your risk until we receive them.

7.3 Change-of-mind returns are not available for:

  1. Goods specially ordered, configured or programmed for you;

  2. Software licences or Subscription Services that have been activated;

  3. SIM cards; or

  4. Goods identified as non-returnable or clearance items at the time of sale.

7.4 This clause 7 does not apply to Goods that are faulty, incorrect or damaged in transit. Those are covered by clause 8, Part C and the ACL.

8. Idatanet warranty

8.1 We warrant that the Goods will be free from defects in materials and workmanship for the warranty period shown on the Product page in the Online Store or in the Quote, or, if no period is shown, 12 months from the date of delivery (Warranty Period). We administer this warranty for all Goods, including where the warranty is backed by the manufacturer.

8.2 This warranty does not cover:

  1. fair wear and tear, or consumable items;

  2. damage caused by misuse, accident, neglect, lightning, power surges, water or dust ingress beyond the Goods' stated rating, or use outside the manufacturer's specifications or instructions;

  3. Goods whose hardware or firmware has been modified, or that have been repaired, by anyone other than us or an authorised service agent;

  4. problems caused by third-party telecommunications networks, SIM cards, coverage or network changes (including network shutdowns); or

  5. Goods that have been tampered with or whose serial numbers have been removed.

8.3 To make a warranty claim, contact us within the Warranty Period at 03 9437 0255 or administration@idatanet.com.au, or write to Idatanet Pty Ltd, 1 Contour Close, Research VIC 3095. Please give us your order number, the serial number, a description of the fault and any troubleshooting steps you have taken. We may ask you to help us diagnose the fault remotely, or to send the Goods to us using a return authorisation number.

8.4 If your claim is valid, we will repair or replace the Goods or refund the Price you paid for them. We will bear the cost of the repair or replacement Goods, and will pay or reimburse the reasonable cost of returning the Goods to us and of sending them back to you. Otherwise, you bear your own expenses of making a claim. If we find no fault after testing, we may charge a reasonable testing fee and return freight, but only if we told you about that fee before you sent the Goods to us.

8.5 Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods. The repair of the goods may result in the loss of any user-generated data. Please back up your device configuration before sending Goods for repair.

8.6 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8.7 The benefits given to you by this warranty are in addition to other rights and remedies under a law in relation to the goods to which the warranty relates.

9. Software, firmware and cloud services

9.1 Software is licensed, not sold. You may use Software only with the Goods with which it is supplied and in accordance with the manufacturer's licence terms, which we will provide on request.

9.2 Firmware updates and manufacturer cloud services are provided by the relevant manufacturer, and their availability and features are set by the manufacturer. Where we sell access to a cloud service, Part D applies.

9.3 You are responsible for configuring and operating the Goods securely, including setting strong passwords, keeping firmware up to date and securing the networks to which the Goods are connected.

9.4 Nothing in these Terms transfers to you any Intellectual Property Rights in the Products, the Online Store or any materials we provide.

10. Your account and the Online Store

10.1 You are responsible for keeping your Online Store login details secure and for Orders placed using your account. Please tell us promptly if you suspect unauthorised use.

10.2 Your use of the Online Store is also subject to our Website Terms of Use.

11. Privacy

11.1 We collect, use and disclose personal information in accordance with our Privacy Policy, available in the Online Store, including to process Orders, deliver Products, manage accounts, assess Trade Account Applications and recover debts.

11.2 We will only send you marketing emails if you have consented, and you can unsubscribe at any time using the link in each email.

12. Force majeure

12.1 A party is not liable for any failure or delay in performing its obligations (other than an obligation to pay money) to the extent caused by a Force Majeure Event, if it notifies the other party promptly and takes reasonable steps to minimise the effect.

12.2 If a Force Majeure Event prevents performance for more than 20 consecutive Business Days, either party may cancel the affected Order by written notice, and we will refund any amount paid for Products not supplied.

13. Orders from outside Australia and New Zealand

13.1 We may accept or decline, at our discretion, an Order for delivery outside Australia and New Zealand. If we decline it, we will refund any amount you have paid.

13.2 If we accept such an Order:

  1. prices are in Australian dollars and exclude any import duties, taxes, customs charges and brokerage in the destination country, which you must pay;

  2. you are the importer of record and are responsible for ensuring that the Goods may lawfully be imported and used in the destination country, including any radio frequency, certification or labelling requirements. Our Goods are certified for use in Australia and New Zealand, and we do not represent that they comply with the requirements of any other country; and

  3. the laws of Victoria apply, but nothing in these Terms limits any right you have under the consumer laws of your country that cannot be excluded.

13.3 You must not export, re-export or supply Products in breach of any applicable export control or sanctions law, and we may decline any Order that would require us to do so.

13.4 The United Nations Convention on Contracts for the International Sale of Goods does not apply to any Agreement.

14. Complaints

14.1 If you have a complaint, please contact us at administration@idatanet.com.au or 03 9437 0255. We will acknowledge your complaint within 2 Business Days and aim to resolve it within 15 Business Days. If you are not satisfied, Consumers may contact Consumer Affairs Victoria or the fair trading agency in their State or Territory (or, in New Zealand, the Commerce Commission or Disputes Tribunal).

15. General

15.1 Notices under these Terms may be given by email to the email address last notified by the recipient. An email notice is taken to be received when sent, unless the sender receives a notice that it was not delivered. A notice received after 5.00 pm, or on a day that is not a Business Day, is taken to be received on the next Business Day.

15.2 We may update these Terms from time to time by publishing the updated Terms in the Online Store. Updated Terms apply only to Orders placed after they are published. For Trade Account holders, we will give at least 30 days' written notice of any material change. For Subscription Services, clause 34 applies.

15.3 These Terms are governed by the laws of Victoria, and each party submits to the non-exclusive jurisdiction of the courts of Victoria.

15.4 You must not assign your rights under an Agreement without our written consent, which we will not unreasonably withhold. We may assign our rights and obligations to a related body corporate or to a purchaser of all or part of our business by notice to you.

15.5 A failure or delay in exercising a right is not a waiver. If any provision of these Terms is void, unenforceable or illegal, it is severed to the extent necessary without affecting the rest of these Terms.

15.6 Subject to clause 1.3 and any rights that cannot be excluded by law, each Agreement is the entire agreement between you and us about its subject matter.

Part B – Business Customers

16. Application of Part B

16.1 This Part B applies to Business Customers. If a Business Customer is also a Consumer, Part C also applies and prevails to the extent of any inconsistency.

17. Trade Accounts

17.1 Business Customers may apply for a Trade Account by completing a Trade Account Application. We may approve or decline an application, and set or change a credit limit, acting reasonably.

17.2 Unless otherwise agreed in writing, invoices issued on a Trade Account are due for payment 30 days after the end of the month in which the invoice is issued (Due Date).

17.3 We may require payment before dispatch, or suspend or withdraw a Trade Account by written notice, if an amount is overdue, your credit limit would be exceeded, or we reasonably consider that your creditworthiness has become unsatisfactory.

17.4 If you dispute an invoice in good faith, you must notify us in writing within 14 days of the invoice date, giving reasons, and pay any undisputed amount by the Due Date. We will work with you in good faith to resolve the dispute promptly.

18. Late payment

18.1 If you do not pay an amount by the Due Date and have not paid it within 5 Business Days after we give you a written reminder, or if you are the subject of an Insolvency Event, then, without limiting our other rights, we may:

  1. suspend further deliveries and Subscription Services (in accordance with clause 35.3 for Subscription Services);

  2. cancel Orders that have not yet been dispatched;

  3. recover Goods in accordance with clause 19.2(c);

  4. charge interest on the overdue amount at the Default Rate from the Due Date until payment; and

  5. suspend or close your Trade Account.

19. Retention of title

19.1 Where Goods are supplied on a Trade Account, title in the Goods passes to you only when we have received payment in full of all amounts you owe us.

19.2 Until title passes:

  1. subject to clause 19.3, you hold the Goods as our bailee and must store them so that they can be identified as our property;

  2. you must insure the Goods for their full replacement value;

  3. if an amount you owe us is more than 10 Business Days overdue after a written reminder, we may, by reasonable notice, require you to return Goods that have not been sold or installed. If you do not do so, you grant us a licence to enter your premises during business hours to recover them, and you must use reasonable endeavours to obtain any third-party consent we need to enter premises where the Goods are stored. We will take reasonable care to avoid damage when recovering Goods; and

  4. you must not grant any security interest in the Goods. If you do, all amounts you owe us become immediately due and payable.

19.3 Despite clause 19.2, you may resell the Goods in the ordinary course of your business. Any amount you receive for the Goods is held on trust for us, up to the amount you owe us for those Goods, and must be paid to us as soon as practicable. If you incorporate the Goods into other goods before title passes, you hold on trust for us a proportion of any payment you receive for those goods equal to the amount owing to us for the incorporated Goods.

19.4 If an Insolvency Event occurs in relation to you, any sale of Goods in which title has not passed will not be in the ordinary course of your business, and the proceeds will, to the extent of the amount you owe us, be held on trust for us.

20. PPSA

20.1 You acknowledge that each Agreement for Goods supplied on a Trade Account is a security agreement for the purposes of the PPSA, under which you grant us a security interest in the Goods (and their proceeds) to secure all amounts you owe us.

20.2 You:

  1. consent to us registering any security interest under these Terms on the PPSR;

  2. must promptly do anything we reasonably request to ensure our security interest is perfected, remains continuously perfected and has the priority we require;

  3. must pay our reasonable costs of registering a financing statement or financing change statement, and of enforcing our security interest;

  4. must give us at least 10 Business Days' prior written notice of any change to your name, ABN or address;

  5. must not register a financing change statement in relation to our security interest without our prior written consent; and

  6. waive your right to receive a verification statement under section 157 of the PPSA.

20.3 To the extent permitted by section 115 of the PPSA, the parties contract out of each provision of the PPSA referred to in sections 115(1) and 115(7) of the PPSA.

20.4 Neither party may disclose information of the kind referred to in section 275(1) of the PPSA, except as permitted by section 275(7) of the PPSA.

21. Liability to Business Customers

21.1 Nothing in these Terms excludes, restricts or modifies any Consumer Guarantee or any other right or remedy that cannot lawfully be excluded, restricted or modified.

21.2 Subject to clause 21.1, all conditions, warranties, guarantees and representations that are not expressly set out in these Terms are excluded to the maximum extent permitted by law.

21.3 If a Business Customer is a Consumer and the Goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, then, to the extent permitted by section 64A of the ACL, our liability for a failure to comply with a Consumer Guarantee (other than a guarantee under sections 51, 52 or 53 of the ACL) is limited, at our option, to replacing or repairing the Goods, supplying equivalent goods, or paying the cost of doing so; or, for services, supplying the services again or paying the cost of having them supplied again.

21.4 Subject to clause 21.1, neither party is liable to the other for any Consequential Loss arising out of or in connection with an Agreement, however caused. This clause does not limit your obligation to pay amounts due, or either party's liability for fraud, wilful misconduct, death or personal injury, or infringement of the other party's Intellectual Property Rights.

21.5 Subject to clauses 21.1, 21.3 and 21.4, our total liability to a Business Customer arising out of or in connection with an Agreement is limited to the Price paid or payable under that Agreement or, for Subscription Services, the fees paid in the 12 months before the event giving rise to the claim.

21.6 Each party's liability is reduced to the extent that the other party, or a person for whom it is responsible, caused or contributed to the relevant Loss.

21.7 You have made your own assessment of the suitability of the Products for your needs. If you tell us in writing of a particular purpose for which you require Products, we will tell you if we are aware that they are unsuitable for that purpose. Except for statements in a Quote, our written product documentation or other written communications from us, you have not relied on any representation by us. This clause does not limit any right you have under the ACL.

22. Indemnity

22.1 You indemnify us against all Losses (including reasonable legal costs) that we incur to the extent they arise from:

  1. recovering overdue amounts you owe us, including reasonable debt collection fees;

  2. your breach of an Agreement; or

  3. any negligent or wilful act or omission by you or any person for whom you are legally responsible.

22.2 Your liability under this clause is reduced to the extent that we or a person for whom we are responsible caused or contributed to the relevant Loss.

23. Resellers and integrators

23.1 If you resell Goods, or supply them as part of a solution to your own customers, you must:

  1. not make any representation about the Goods that is inconsistent with the manufacturer's specifications or our product documentation, or give any warranty on our behalf;

  2. not remove or alter any compliance labels, serial numbers or safety information on the Goods; and

  3. comply with all laws that apply to your supply of the Goods, including the ACL.

23.2 You acknowledge that, as the supplier to your customers, you are responsible to them under the ACL, without limiting any right you have against us.

24. New Zealand business customers

24.1 If you are in New Zealand and acquire Products in trade, the parties agree that, to the extent permitted by section 43 of the Consumer Guarantees Act 1993 (NZ) and section 5D of the Fair Trading Act 1986 (NZ), the Consumer Guarantees Act 1993 does not apply, and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, to any Agreement. The parties agree that it is fair and reasonable for them to be bound by this clause.

Part C – Consumers

25. Your rights under the Australian Consumer Law

25.1 This Part C applies if you are a Consumer. It prevails over anything else in these Terms to the extent of any inconsistency.

25.2 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

25.3 Our services also come with guarantees that cannot be excluded under the ACL. For a major failure with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

25.4 Nothing in these Terms excludes, restricts or modifies any of those rights, and any provision of these Terms that would do so does not apply to you.

26. Faulty, incorrect or damaged goods

26.1 If Goods are faulty, are not what you ordered, or arrived damaged, please contact us. You do not need to rely on the Idatanet warranty, and the time limits in the warranty and in clause 4.7 do not limit your rights under the ACL.

26.2 Where we ask you to return Goods, we will pay the reasonable cost of return if the Goods have failed to meet a Consumer Guarantee. If returning the Goods would involve significant cost to you (for example, because they are installed or bulky), we will collect them at our own expense within a reasonable time.

26.3 Your rights are not affected by whether you still have the original packaging, although we may ask for proof of purchase.

27. What does not apply to you

27.1 If you are a Consumer who is not buying Products for a business, Part B does not apply to you.

27.2 Clause 4.7 does not require you to report problems within a fixed time, and you will not lose any ACL right because you report a problem after delivery.

28. Change of mind

28.1 In addition to your rights under the ACL, you may return Goods under our change-of-mind policy in clause 7.

29. Complaints and disputes

29.1 If something goes wrong, please contact us first using the details in clause 14. If we cannot resolve your concern, you can contact Consumer Affairs Victoria or the fair trading agency in your State or Territory. If you are in New Zealand, you also have rights under the Consumer Guarantees Act 1993 (NZ) and the Fair Trading Act 1986 (NZ), which these Terms do not limit.

Part D – Subscription Services

30. Application of Part D

30.1 This Part D applies to Subscription Services, such as SIM and data plans, cloud device management, software subscriptions, support plans and extended warranties that we supply on a recurring basis. Parts A, B and C also apply as relevant.

31. What we tell you before you subscribe

31.1 Before you subscribe, we will clearly show you on the Product page, in the order summary and in your confirmation email: the price and how often you will be charged; any minimum term; whether and how the subscription renews; any early termination fee; and how to cancel.

31.2 If we offer a free or discounted trial that will convert to a paid subscription, we will tell you this before you sign up, and remind you at least 7 days before the trial ends.

32. Term and renewal

32.1 A Subscription Service starts when it is activated and continues for the term shown when you subscribed.

32.2 Monthly subscriptions renew each month until cancelled.

32.3 Fixed-term subscriptions renew for the same term unless you cancel before the renewal date. We will remind you at least 30 days (and no more than 60 days) before a fixed term of 12 months or longer renews, telling you the renewal price and how to cancel.

33. Cancelling a subscription

33.1 You can cancel a Subscription Service at any time through your Online Store account or by emailing administration@idatanet.com.au. Cancelling will never be harder than signing up. We will confirm your cancellation in writing.

33.2 Unless otherwise stated when you subscribed, cancellation of a monthly subscription takes effect at the end of the current billing period, and no cancellation fee applies.

33.3 If you cancel a fixed-term subscription before the end of its minimum term, you must pay any early termination fee disclosed when you subscribed. That fee will not exceed the fees remaining for the minimum term, or our reasonable costs caused by the early cancellation, whichever is lower.

34. Price and service changes

34.1 We may change the price or features of a Subscription Service by giving you at least 30 days' written notice. If you do not accept a change that is to your detriment, you may cancel the Subscription Service before the change takes effect, without any cancellation or early termination fee.

34.2 If an upstream provider (such as a mobile network operator or software manufacturer) withdraws or materially changes a service, we may end or change the affected Subscription Service by giving you as much notice as practicable (and at least 30 days where possible). We will refund any fees you have paid for the period after it ends.

35. Using Subscription Services

35.1 SIM and data plans rely on third-party mobile networks. We do not guarantee coverage or uninterrupted service, and network changes (such as network shutdowns) are outside our control. Any excess usage charges will be disclosed when you subscribe.

35.2 You must use Subscription Services only for lawful purposes, in compatible equipment, and in accordance with any fair use policy disclosed when you subscribe.

35.3 We may suspend a Subscription Service if an amount for it is more than 30 days overdue and you have not paid within 10 Business Days after we give you written notice warning of the suspension, or to the extent reasonably necessary to prevent misuse, fraud or harm to our or a provider's network. We will restore the service promptly once the reason for suspension has been resolved.

36. Your data

36.1 We handle data processed through Subscription Services in accordance with our Privacy Policy. When a cloud Subscription Service ends, we will, on request made within 30 days, give you an export of your data where the platform allows, and may then delete it.

Website policies

Version 1.0 · Effective 19 October 2026

The policies below are plain-English summaries of, and companions to, our Terms of Sale. If there is any inconsistency, the Terms of Sale prevail.

Returns, refunds and warranty policy

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in this policy limits those rights. If something you bought from us is faulty, not as described, or not what you ordered, contact us and we will put it right.

Change of mind

If you change your mind, you can return Goods within 14 days of delivery if:

  • you contact us first for a return authorisation (RA) number;

  • the Goods are unused and in their original unopened, sealed packaging, with all accessories, manuals and labels; and

  • they can be resold as new.

We will refund the price less a 15% restocking fee within 10 business days of receiving and checking the return. Original delivery charges are not refunded, and you pay the cost of sending the Goods back.

Change-of-mind returns are not available for Goods specially ordered, configured or programmed for you; activated software licences or subscriptions; SIM cards; or items marked as non-returnable or clearance at the time of sale.

Faulty, incorrect or damaged goods

Please contact us as soon as possible with your order number and a description (photos help). We may troubleshoot with you remotely first, as many issues with routers and gateways can be fixed by configuration or a firmware update.

If the Goods need to come back, we will give you an RA number and pay the reasonable cost of return where the Goods have failed to meet a consumer guarantee. If returning the Goods would cost you significantly (for example, because they are installed or bulky), we will arrange collection at our expense.

Idatanet warranty

As well as your consumer guarantee rights, we warrant our Goods against defects in materials and workmanship for the period shown on the product page (or 12 months from delivery if no period is shown).

What's not covered: fair wear and tear and consumables; damage from misuse, accidents, lightning or power surges; water or dust beyond the product's rating; modified hardware or firmware; repairs by anyone other than us or an authorised agent; and problems caused by mobile networks, SIM cards, coverage or network changes.

How to claim: contact us within the warranty period at 03 9437 0255 or administration@idatanet.com.au, or write to Idatanet Pty Ltd, 1 Contour Close, Research VIC 3095. Include your order number, the serial number, a description of the fault and the troubleshooting steps you have tried.

What we'll do: if your claim is valid, we will repair or replace the Goods or refund you. We cover the cost of the repaired or replacement Goods and reasonable freight both ways. Otherwise, you bear your own expenses of making a claim. If testing finds no fault, we may charge a testing fee and return freight, but only if we tell you about that fee before you send the Goods.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods. The repair of the goods may result in the loss of any user-generated data. Please back up your device configuration before sending it to us.

The benefits given to you by this warranty are in addition to other rights and remedies under a law in relation to the goods to which the warranty relates.

Business customers

Business customers should report shortages, incorrect items or transit damage within 5 business days of delivery. Business customers who are also "consumers" under the Australian Consumer Law (for example, purchases of $100,000 or less) keep all their consumer guarantee rights.

Shipping and delivery policy

Where we deliver

We deliver to addresses in Australia and New Zealand. We may accept orders for other countries at our discretion. If we do, you are responsible for import duties, taxes and customs charges, and for checking that the products can lawfully be imported and used in your country. Our products are certified for use in Australia and New Zealand.

Delivery charges and times

Delivery charges are shown at checkout before you pay. In-stock orders placed before 12:00 pm AEST/AEDT on a business day are usually dispatched the same or next business day. Estimated delivery times are shown at checkout and are estimates only.

If we split your order into more than one shipment, we don't charge extra for delivery.

Delays

We will let you know if we expect a significant delay. If your order hasn't arrived within 30 days of the estimated delivery date (and the delay isn't caused by you), you can cancel the undelivered items for a full refund, including delivery charges.

Authority to leave

If you choose "authority to leave", your order is treated as delivered once the carrier leaves it at your address.

Lost or damaged in transit

If your parcel is lost or arrives damaged, contact us. We will send a replacement or give you a full refund. Business customers should report transit damage within 5 business days.

Incorrect address

Please check your delivery address carefully. If a parcel is returned because the address was incorrect or incomplete, we may charge the cost of redelivery.

Collection

If collection is offered at checkout, you can collect from 1 Contour Close, Research VIC 3095 during business hours once we tell you your order is ready.
